These Terms and Conditions of Use (hereinafter the “Terms”) are intended to define
the terms and conditions of access to and use of the MyBestSim website, available at www.mybestsim.com (hereinafter the “Site”).

By accessing the Site, the User acknowledges having read these Terms and accepts them without reservation. The term “User” refers to any person who accesses the Site to consult its information or use its service.

Purpose of the Service

MyBestSim is an independent comparator of eSIM plans. It allows the User to view and compare various commercial offers provided by mobile network operators and third-party resellers of eSIM cards (hereinafter jointly the “eSIM Providers”).


MyBestSim is neither a cell phone operator nor an eSIM card reseller. It does not market any services directly via the Site. It only offers digital products and services that redirect users to partners.

By using the Site’s service, the User may be redirected to the websites of these eSIM Providers to obtain further information and to subscribe to an offer at their discretion.

Liability

MyBestSim makes every effort to provide clear, up-to-date and reliable information. However, the User is reminded that the offers displayed on the Site originate from third-party eSIM Providers and that the prices, terms, eligibility, options and any other elements of these eSIM offers may be changed at any time by said eSIM Providers.

MyBestSim does not guarantee the completeness or real-time updating of the information
displayed.

Each offer presented is subject to the general terms and conditions of the relevant eSIM Provider. MyBestSim cannot be held liable for the content, changes or the quality of the services offered by the referenced eSIM Providers. It is the User’s responsibility to verify the exact terms of the offer on the eSIM Provider’s website before subscribing.

In general, MyBestSim’s liability cannot be incurred in the event of:

  • Misinterpretation or misuse of the information provided on the Site
  • Subscription by the User to an unsuitable or unsatisfactory offer
  • Dispute between a User and an eSIM Provider
  • Malfunction or temporary unavailability of the Site

It is also noted that although the Site is accessible 24/7, the Site Publisher reserves the right to suspend access temporarily for technical, maintenance or security reasons.

No right to compensation shall be granted to the User in the event the Site is interrupted.

Access to the Site

Access to the Site is free of charge for all Users. Any use of the Site must comply with these Terms as well as applicable law.

The following are strictly prohibited in particular:

  • extracting, reusing or reproducing, even partially, the Site’s content and data, in particular for commercial or resale purposes;
  • any attempt to automatically harvest data (scraping, bots, etc.);
  • misuse or fraudulent use of the Site’s comparison tools and features;
  • any use infringing the intellectual property rights of MyBestSim, the eSIM Providers or third parties (see Article 4 below)

The Site Publisher reserves the right to restrict or block access to any User in the event of abusive, fraudulent or non-compliant use with these Terms.

Intellectual Property

All content on the Site (texts, images, data, logo, structure, etc.) is protected under the French Intellectual Property Code.

In addition to intellectual property elements belonging to MyBestSim, certain images, logos, texts or visuals used may also belong to the eSIM Providers referenced on the Site or originate from third parties who have granted their authorization. These elements are presented solely to illustrate commercial offers and remain the property of their respective owners.

Any reproduction, modification, distribution or exploitation of the Site’s content, in whole or in part, without the Site Publisher’s prior written authorization, is strictly prohibited.

Affiliate Links and Partnerships

Some links on the Site may be affiliate links, which means the Site Publisher may receive compensation if the User subscribes to an offer or purchases a service via these links redirecting to the eSIM Providers’ websites. Such redirection comes at no additional cost to the User.

This compensation does not influence the ranking or selection of the offers presented. As an eSIM offer comparator, MyBestSim undertakes to remain transparent, factual and independent in its comparisons.

Changes to the Terms

These Terms may be amended at any time. The applicable version is the one displayed online.

Governing Law and Jurisdiction

These Terms are governed by French law. In the event of a dispute, and unless otherwise required by mandatory legal provisions, the French courts shall have exclusive jurisdiction.

In accordance with the rules of private international law, any User qualifying as a consumer may nevertheless bring proceedings before the courts of their habitual residence, if the applicable law of their country of residence so provides.
